What the Montreal Convention covers
The Convention makes the carrier liable for destruction, loss or damage to checked baggage while it is in the carrier's charge, subject to the Convention's rules and defences. It also addresses damage caused by delay. The current international liability ceiling is expressed in Special Drawing Rights, not as an automatic cash award.
A claimant must prove the actual loss. Airlines commonly consider age, condition and depreciation rather than providing new-for-old replacement.
Delayed bags and essential purchases
Buy only reasonable essentials while separated from the bag and retain itemised receipts. Clothing, toiletries and necessary medication may be recoverable depending on the circumstances. A passenger returning home may face a stricter necessity assessment than someone stranded away from home.
Air Peace's published baggage policy says the baggage tag is required to retrieve delayed or missing baggage and treats international baggage as presumed lost after 21 days.
